1. I am eighteen (18) or more years of age. 2. Grant of rights. I, the undersigned, hereby grant to CBS Digital Media ("CBSDM"), its parent, affiliates, successors, assignees and licensees (together with CBSDM, "CBS"), the irrevocable and perpetual right to display my name and the attached photograph of myself (the "Photograph") on STARTREK.COM and any other Web site owned or operated by CBS (together with STARTREK.COM, the "Sites"). I further grant CBS the right to crop or otherwise size the Photograph as it determines in its sole discretion. 3. No obligation to use. I acknowledge that my submission of the Photograph and my execution of this Release in no way obligates CBS to use the Photograph. I understand that the Photograph will not be returned and will become property of CBS. 4. No payment. I understand that I will not be paid any money for the Photograph or the rights granted herein. 5. Release. I understand and acknowledge that users of the Sites may be able to "download" the Photograph. I will never sue CBS or anyone because CBS did not use the Photograph or because I do not like the manner in which CBS used the Photograph. I hereby release, and agree to hold harmless, CBS from and against any and all claims, demands and causes of action of every kind and nature, which I may now have or may hereafter acquire, arising out of or in connection with CBS's use of the Photograph, including without limitation, any and all claims for invasion of privacy, infringement of my right of publicity, defamation, any other personal and/or property rights and any and all claims arising out of third party use of the downloaded Photograph. 6. Other. In signing this release, I have not relied on any representations or other statements that are not contained herein. I represent that I am the copyright owner of the Photograph, that I am the individual depicted in the Photograph, that I have the authority to grant CBS the permission and rights herein granted, and that there are no other permissions required with respect to the rights herein granted. Under penalty of perjury, I certify that the information shown below and the representations given or made by me, which are contained herein, are correct. The laws of the state of California shall govern this agreement and the courts located in Los Angeles County, California shall have exclusive jurisdiction over any dispute relating to this agreement.
