Yes, I was aware of it.  Thankfully, that nutjob will still spend the rest of his life behind bars.

Martin Bryant and Chopper Reed are also serving back to back life sentences at Risdon, as Australia no longer has a death penalty either.

Yes, unfortunately.  The alternative, would be to release him.  Considering his original sentence, crimes and mental stability... releasing him is not a good option.

I'd think the alternative is the original penalty.

I would have preferred that as well.  It looks like that option is permanently off the table now.

Why?  CA's Supreme Court can reinstate it.

I was under the impression that the new law allowing for the death penalty in CA could not be retroactively applied.  So those (including Manson) who had their sentences commuted to life imprisonment were now exempt unless of course new crimes/sentences were to happen.

But can't the court act under the law during the time that he was convicted?

The original legislation was declared to be cruel and unusual punishment and in violation of the state Constitution. So everyone on death row got off and was resentenced.

Sounds like they could resentence under the current law.  But then again.... law ≠ justice.
